Foundry terms
Last updated: 29 October 2026
These terms are an agreement between Giftease Solutions Limited (company number 12192220, registered office 86 Beaver Road, Maidstone, Kent, ME16 0FN, VAT number 332421345; "we", "us") and the charity that opens a Foundry account ("you"). Our Data Processing Agreement (the "DPA") forms part of these terms.
1. Accepting these terms
1.1 You accept these terms when a person ticks the box at sign-up or when you start a paid plan. That person confirms they are authorised to accept them on the charity's behalf.
1.2 Foundry is for charities and community amateur sports clubs (CASCs) only. We open an account only for an organisation we can verify (a registered charity, or one with an HMRC charity reference) and for a person who shows they belong to it.
1.3 If there's a conflict, the DPA wins on anything about personal data; these terms win on everything else.
2. What Foundry is
2.1 Foundry helps you collect Gift Aid declarations from your supporters (by letter, email, a form on your website, a hosted page or an API) and keeps each declaration with its evidence.
2.2 You make your Gift Aid claims, not us. Foundry records declarations. You're responsible for checking that each gift and declaration qualifies before you claim it from HMRC.
2.3 Features marked "coming soon" or "beta" aren't part of what you pay for until we release them. We may change or withdraw a beta feature.
3. Your account
3.1 You name at least one administrator. They manage your users and your plan.
3.2 Keep sign-in details safe, and tell us at once at support@gift-ease.co.uk if you think someone has used your account without permission.
3.3 You're responsible for what your users do in your account.
4. Plans and credits
4.1 Foundry is priced in credits. A credit pays for an ask: each letter or email to a supporter, or each capture on your donation form, as set out on our pricing page. Whitemail (declarations that come back by post) uses 1 credit per item we process, taken when the item is processed. A supporter's yes is always free, and a yes is never refused because you're out of credits.
4.2 Free plan: 100 credits a month, for as long as you have an account. Free credits don't roll over.
4.3 Paid plans are monthly or annual, at the prices on our pricing page when you choose them.
- Monthly plans add your plan's credits each month. Unused credits roll over for 1 month, then expire.
- Annual plans give you the whole year's credits on the first day. They last 12 months from that day.
4.4 Bundles are one-off credits. They last 12 months from purchase.
4.5 We use your oldest credits first, so the fewest expire.
4.6 Credits have no cash value. They can't be refunded, exchanged for cash or moved to another organisation, except where the law requires it.
5. Prices and payment
5.1 Prices are shown excluding VAT. We add VAT at the current rate, and your invoice shows it.
5.2 You pay by card through our payment provider, Stripe. Monthly plans are charged each month and annual plans each year, in advance.
5.3 If a payment fails, we'll email your administrators and try again. If it's still unpaid after 14 days, your account moves to the Free plan. You keep your data and any declarations you've collected; only the paid allowance stops.
5.4 We may change our prices. We'll tell you at least 30 days before a new price applies to you, and it applies from your next renewal. You can cancel before then.
6. Renewal, cancellation and changing plans
6.1 Paid plans renew automatically at the end of each period until you cancel.
6.2 You can cancel at any time in your account. Your plan runs to the end of the period you've paid for, then your account moves to the Free plan. We don't refund part-periods, with one exception: if you cancel an annual plan within 14 days of its first payment and haven't used any of its credits, we refund that payment in full.
6.3 Upgrading takes effect at once. We charge the difference for the rest of the period, and your extra credits are added straight away.
6.4 Downgrading takes effect at the end of the current period.
6.5 Credits you've already bought stay usable until they expire, even after you cancel or downgrade.
7. What you're responsible for
7.1 You're the controller of your supporters' personal data, and we process it for you under the DPA. You're responsible for:
- having a lawful basis to contact your supporters and to send us their data;
- your own privacy notice, including any consent you need to email supporters;
- the accuracy of the data you upload;
- making sure your Gift Aid claims meet HMRC's rules.
7.2 You must not use Foundry to send anything unlawful, misleading or unrelated to Gift Aid, or to contact people you have no right to contact.
7.3 You must not try to copy, take apart or get around the security of Foundry, or access another organisation's data.
8. Support
8.1 Foundry is designed to be self-serve. Technical support covers using our software. It's included as shown on the pricing page (1 hour a year on Essentials, 2 on Plus), then charged at 250 credits per 15 minutes.
8.2 We reply to support requests within two working days.
8.3 Gift Aid advice and consultancy is campaign management. It's not technical support, and it's agreed and priced separately.
9. Availability and changes to Foundry
9.1 We work to keep Foundry available, but we don't promise it will never be interrupted. We'll give notice of planned maintenance where we can.
9.2 We may improve or change Foundry. We won't remove a core feature you're paying for during your current period without telling you and offering a pro-rata refund of that period.
10. Your data and our software
10.1 Your data stays yours. You give us permission to use it only to provide Foundry to you, as the DPA sets out.
10.2 Foundry, our software, our templates and our brand belong to us or our licensors. You get a right to use Foundry for your charity while your account is open.
10.3 If you send us ideas or feedback, we may use them without owing you anything.
11. Confidentiality
Each of us keeps the other's confidential information confidential and uses it only for this agreement, unless the law requires otherwise.
12. Liability
12.1 Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else the law doesn't allow us to limit.
12.2 We're not liable for:
- Gift Aid that HMRC refuses or recovers because of data, declarations or claims you supplied or made;
- loss of profit, income or opportunity, or any indirect loss.
12.3 Otherwise, our total liability in any 12 months is limited to the fees you paid us in the 12 months before the claim.
13. Suspension and ending this agreement
13.1 We may suspend your account at once if you seriously break these terms, if we reasonably think your account is being misused, or if the law requires it. Where we can, we'll tell you why and how to put it right.
13.2 Either of us can end this agreement:
- you, by closing your account;
- us, by giving you 30 days' notice, or at once if you seriously break these terms and don't put it right within 14 days of our notice.
13.3 When it ends, your administrators can download your data for 30 days. We email every administrator when it's ready and again before we delete it. If none of them can sign in, a trustee or your chief executive can ask us to appoint a new administrator. We then delete your data within 30 days, as the DPA sets out, and confirm in writing.
14. Changes to these terms
We may update these terms. We'll email your administrators at least 30 days before a change that affects you materially. If you don't agree, you can cancel before it takes effect.
15. General
15.1 These terms, the DPA and the plan you choose are the whole agreement between us about Foundry.
15.2 You can't transfer this agreement without our written agreement. We may transfer it to a company that takes over Foundry, and we'll tell you if we do.
15.3 Nobody else has rights under these terms.
15.4 We send notices by email to your administrators. You send notices to support@gift-ease.co.uk.
15.5 These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction.
